TERMS & CONDITIONS FOR VENDORS:
LIABILITY EXCLUSIONS
Portobello West is not responsible for any loss, fine, penalty, judgment, legal fees, and expenses arising from your failure to comply with Portobello West’s Terms of Agreement or from any liability, negligence, gross negligence or injury resulting from your products, actions, conduct, booth setup, display, or trade activities.
INSURANCE
Annual liability insurance or day of insurance is MANDATORY to participate.
PAYMENT
Payment is due within 3 business days upon notice of acceptance as a vendor via electronic PayPal or certified cheque – no exceptions. Payment is due within 1-business day, when the market date is 2 weeks away or less. Payment is due immediately on receipt of invoice If the application is submitted after the application deadline has closed. Payments not received by the deadline date specified will result in immediate release of your reserved vendor spot(s) to the next qualified applicant. Please ensure that you are available for the market(s) you’ve requested before submitting your application.
REFUND POLICY
Vendor cancellations more than 31-days before the market date will receive a 50% refund with no exceptions. Vendor cancellations less than 31-days before the market date will receive no refund with no exceptions. Please contact the Market Manager at manager.van@portobellowest.com for all cancellation requests.
ACTS OF GOD
Portobello West has no obligations to run a market in the event of a cancellation due to an Act Of God outside the control of Portobello West such as fire, global pandemic, flooding, earthquake, riot, war or other hostility, or any other hazardous situation or natural disaster. Vendor booking fee(s) will be rolled over and applied towards a future Market date with no refund. No exceptions.
EVENT PROTOCOL
Vendors are responsible for the collection of sales tax and credit/debit services. A vendor package complete with all details will be emailed 3-days prior to Market date.Vendors must be market ready 15-minutes prior to public start time. Vendors must comply with load-in and teardown instructions, as well as onsite vendor table placement predetermined by the Market Manager. Vendors must remain set up in their spaces until the Market closes. Early teardowns are not permitted. Vendors are required to bring all garbage and recycling home and must leave vendor spaces clean prior to vacating. Vendors and food trucks are responsible for obtaining all required health and business permits, licenses and insurance approved by health authorities, municipalities, venue management, and Portobello West’s Market Manager. Vendors must only sell the products specified in their application category unless prior approval is obtained from the Market Manager.
